Please note that Believe is currently operating in Public Beta v1.0.0. While all core platform systems—including AI tutor matching, parent billing, live WebRTC video classrooms, rescheduling engines, and direct messaging—have undergone extensive testing, users acknowledge that occasional bugs, typographical mistakes, visual UI anomalies, or temporary service latency may still occur. By participating in this Public Beta, you acknowledge that services are provided on a beta release basis, and we warmly welcome your feedback to help us continuously refine and improve the platform directly via the in-app Believe Administrator chat or by emailing us at naproudacademy@gmail.com.
TERMS & CONDITIONS
1. Introduction & Acceptance
Welcome to Believe, an educational platform operated by Naproud Academy ("Company", "we", "us", or "our"). The parent organizational website is hosted at naproudacademy.org (WordPress), and the web application platform operates at believe.naproudacademy.org (hosted on Netlify). By accessing or using our website, web application, or related services (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use the Platform.
2. User Roles & Account Eligibility
Age Requirement: The Platform is intended for users who are at least 13 years of age. By creating an account, you represent that you meet this age requirement.
Account Security: Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
Account Termination: Technical Admins reserve the right to suspend or permanently terminate any account at their discretion for violations of these Terms, abusive behavior, non-payment, or attempts to circumvent the Platform by arranging off-platform payments or contact sharing. Account termination requests submitted by users must be reviewed and processed by Technical Admins.
3. Pricing, Billing, and Tutor Payouts
Admin Pricing Control: Platform Admins retain exclusive control over all financial parameters, including parent/student billing rates (pay-in) and tutor compensation rates (payout). Rates are calculated on an hourly basis.
Payment Processing: All parent/student payments are processed automatically via Stripe. By purchasing sessions or packages on the Platform, you authorize Stripe to charge your designated payment method.
Tutor Payouts: Tutor payouts are calculated automatically by the Platform and processed semi-automatically via Wise (TransferWise) CSV exports reviewed and uploaded by Platform Admins. Tutors act as independent contractors and are solely responsible for reporting and paying any applicable taxes on earnings received.
Off-Platform Transactions: Soliciting or accepting payments outside of the Platform between Tutors and Parents/Students is strictly prohibited and constitutes grounds for immediate account termination.
4. Cancellations, Outages, and Refunds
Cancellations Prior to 24 Hours: If a parent or student cancels a scheduled session more than 24 hours in advance, they are eligible for a makeup session credit.
Cancellations Within 24 Hours: For cancellations made 24 hours or less before the scheduled session time, granting a makeup session or credit is solely at the individual tutor's discretion.
Technical Outages & Tutor No-Shows: If a session fails to occur due to platform technical outages or an unexcused tutor absence:
Users may propose a replacement slot at no extra charge using the built-in rescheduling tools.
Lessons that are cancelled or unheld are automatically excluded from tutor payout calculation batches and parent billing statements.
In the event of a verified tutor no-show, the prepaid credit remains on the parent's account balance, and administrators may manually credit hours or reassign sessions as needed.
No Refunds: All payments made on the Platform are strictly non-refundable once a lesson or session has been completed.
5. Session Disputes & Reporting Window
48-Hour Reporting Window: Any issue, dispute, or complaint regarding a completed session (including quality concerns, missing time, or technical failures) must be submitted via the rating and feedback tool or directly to Platform Admins within forty-eight (48) hours of the scheduled end time.
Payout Holds: Submitting a dispute within the 48-hour window allows Platform Admins to place a temporary hold on the tutor's scheduled Wise payout while the issue is reviewed, chat logs are audited, and potential makeup credits or re-matching solutions are evaluated. Disputes submitted after 48 hours will be processed at the sole discretion of the Admins.
6. Supported Platforms & System Requirements
Supported Platforms: Believe is accessible across iOS, iPadOS, Android, and web.
Supported Web Browsers: The Platform is optimized for modern web browsers including Google Chrome, Apple Safari, Mozilla Firefox, and Microsoft Edge. Users are responsible for maintaining up-to-date browser versions for optimal functionality and security.
Hardware & Permissions: Interactive video sessions require an active internet connection, a functioning camera, and a microphone. Users must grant the browser or application necessary permissions to access camera and microphone inputs for virtual classrooms hosted via Daily.co.
App Updates & Compatibility: We reserve the right to update or enhance application features at any time. We do not guarantee uninterrupted compatibility with outdated operating systems or unmaintained web browsers.
Prohibition of Off-Platform Contact Sharing: To protect minor student safety and preserve platform integrity, tutors, parents, and students are strictly prohibited from sharing personal external contact information—including LINE IDs, personal phone numbers, WhatsApp handles, or personal email addresses.
Child Safeguarding: Minor student accounts have contact fields disabled and hidden by default during onboarding. All academic communication, scheduling requests, homework sharing, and live virtual lessons must take place exclusively within authenticated Believe messaging threads and Daily.co classrooms.
Prohibited Content: Users are strictly prohibited from uploading, publishing, or transmitting any material through chat, homework attachments, or lesson notes that is unlawful, defamatory, abusive, threatening, obscene, fraudulent, or infringing upon any third party's intellectual property or privacy rights.
8. Intellectual Property Rights
User Content Ownership: Tutors and students retain full ownership and copyright of any original slide decks, worksheets, essays, assignments, or study materials they upload to lesson notes or chat threads.
Operational License: By uploading content, users grant Naproud Academy a non-exclusive, royalty-free, limited license to host, display, store, and transmit such materials solely for instructional purposes and academic record-keeping on the Platform.
Platform Assets: Believe and Naproud Academy retain exclusive ownership and intellectual property rights over the platform source code, user interfaces, proprietary matching algorithms, logos, trademarks, and training materials.
9. Disclaimer of Warranties & Limitation of Liability
Public Beta v1.0.0 Status: You expressly understand, acknowledge, and agree that this software version is designated and deployed as Public Beta v1.0.0. While heavily audited, the Platform is provided on an experimental and iterative basis. Naproud Academy disclaims all liability for minor mistakes, typographical errors, unexpected UI behaviors, or temporary service interruptions inherent to a pre-final beta release. Users are encouraged to report any detected bugs or errors to the administration.
No Academic Guarantee: Naproud Academy provides educational matching and lesson tools but does not guarantee specific academic improvements, exam scores, grade increases, or admissions outcomes.
Service Continuity: The Platform is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that service will be uninterrupted or error-free.
Limitation of Financial Liability: To the maximum extent permitted by applicable law, in no event shall Naproud Academy, its directors, officers, employees, or developers be liable for any indirect, incidental, special, consequential, or punitive damages. The total cumulative monetary liability of Naproud Academy arising out of or relating to your use of the Platform shall not exceed the total amount of fees paid by you to the Platform in the twelve (12) months immediately preceding the event giving rise to the claim.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law principles.
11. General Provisions
Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Naproud Academy regarding your use of the Platform and supersede any prior agreements, understandings, or communications, whether oral or written.

PRIVACY POLICY
1. Overview & Legal Framework
Naproud Academy ("we", "us", "our") respects your privacy and is committed to protecting the personal data of users accessing Believe. This Privacy Policy explains what information we collect, how it is used, and your rights regarding your personal data across our primary domain (naproudacademy.org) and application subdomain (believe.naproudacademy.org).
This policy is formulated in compliance with applicable data protection laws, including the Thailand Personal Data Protection Act B.E. 2562 (PDPA).
2. Information We Collect
We collect personal information necessary to provide and improve our educational platform:
Account Information: Name, email address, phone number (where applicable), role type, and authentication credentials. Contact fields for minor accounts are suppressed for safeguarding.
Financial Details: Payment processing details for Parents/Students (handled securely by Stripe) and bank account details for Tutors (processed for Wise CSV payout batching).
Application Data: Session schedules, chat messages, uploaded worksheets, ratings, and administrative dispute records.
Technical & Usage Data: IP address, browser type, device type (iOS, iPadOS, Android, Web), and interaction logs captured during Platform usage.
3. Session Privacy & Video Calls
Unrecorded Video Sessions: Live video classrooms hosted via Daily (Daily.co) operate as real-time interactive streams. Sessions are completely unrecorded.
Data Transience: Audio, video, and screen-share feeds are neither captured nor stored on Daily.co servers, Supabase databases, Netlify hosting infrastructure, or Naproud Academy servers.
4. Cookies & Local Storage
Browser Local Storage: We use browser localStorage strictly for technical operation, user authentication session persistence (Supabase Auth tokens sb-*-auth-token), timetables caching, chat state, and tutor availability preferences.
Cookies: Necessary session cookies are utilized for edge routing on Netlify and WebRTC video connection signaling within Daily.co containers.
No Marketing Trackers: We do not use third-party advertising cookies, cross-site trackers, or marketing analytics pixels (such as Google Analytics or Facebook Pixels).
5. Third-Party Service Providers
We share user data with trusted third-party service providers solely to operate, host, and maintain Platform infrastructure and functionality:
Stripe: Secure payment processing and billing.
Resend: Transactional email delivery and notification routing.
Supabase: Backend database management, security rules, and user authentication.
GitHub: Source code management and deployment pipelines.
Daily (Daily.co): Unrecorded real-time interactive video session hosting.
Netlify: Web application hosting and deployment infrastructure for believe.naproudacademy.org.
WordPress: Parent domain management (naproudacademy.org) and main site hosting.
We do not sell, rent, or trade your personal information to third parties for marketing purposes.
6. Data Storage & Security
We implement technical and organizational measures to safeguard your personal data stored within Supabase and our cloud infrastructure on Netlify. However, no electronic transmission or storage system can be guaranteed 100% secure.
7. User Rights under PDPA, Data Deletion & Inquiries
Under the Thailand Personal Data Protection Act (PDPA) and other applicable data protection regulations, users have specific rights regarding their personal data:
Right to Access & Portability: Request a copy of your personal data stored on the Platform.
Right to Rectification & Erasure: Request correction or permanent deletion of your personal data or account.
Right to Restrict or Object: Restrict or object to specific processing activities.
Right to Withdraw Consent: Withdraw consent for data processing at any time without affecting lawful processing prior to withdrawal.
Right to Lodge a Complaint: Lodge a complaint with the Personal Data Protection Committee of Thailand if you believe your privacy rights under PDPA have been violated.

8. Changes to This Privacy Policy
